When Jewish Halacha And Torah Collide:
A Case in Point: Abortion

When halacha violates Torah the halakhot is invalid.

One might assume that all Jews, especially Orthodox Jews, would agree with this obvious statement. But not so fast. We have today, as we always have, some/many who assimilate with the evil cultures among whom we live. Consider the following from the Babylonian Talmud (b. Beitzah 32b):

Rav Nathan bar Abba said in the name of Rav: “The wealthy [Jews] of Babylonia will be going to Gehennom” [i.e., to destruction]

When Shabtai bar Marinus came to Babylon, he looked for work but could find none. He asked for food, but no one fed him. He (Shabtai) said regarding them: “They must be descendants of the ʿerev rav, for it says (Deuteronomy 13:18), ‘and show you compassion to make you compassionate’—anyone who has compassion on people, it is known that he is a descendant of our father Abraham, and anyone who does not have compassion on people, it is known that he is not a descendant of our father Abraham.”

One very highly regarded Orthodox Jewish source says on it’s website regarding halachic decisions: —any practice, decision or code that is universally accepted by the Jewish people is assumed to represent God's will and is binding as such. Even when a decision is initially disputed, the commonly accepted opinion becomes binding as law... Since the Talmud was accepted by all Israel, it is the final authority in all questions of Torah law.”

Not the Torah of Moshe Rabbeinu? No, not according to many Rabbinic Jews. We at Beit Emunah are Rabbinic Jews and we honor the Talmud always. However the Written Torah revealed to us through the hands of Moshe Rabbeinu, along with the Tanach, are the primary source materials of traditional Judaism. The Talmud helps us understand the Tanach, it does not replace it. As vital as the Talmud is, it is commentary on the Tanach. Abandoning the Written Torah has been costly.

As Rebbe Nachman of Breslov warned:

Great atheism is coming to the world as a test from on high. The world's many sins are causing a terrible lack of faith. Happy is the person who stays firm in his faith in these times.
The fact that I am predicting this will not prevent the increase of Godlessness and confusion. Long ago Daniel and others made it known that this would happen in the days before the Mashiach. "Many will purify themselves and be refined, and make themselves shining white. But the wicked will do evil. and only the wise shall understand" (Daniel 12:10).
Knowing that this has already been foreseen, it would seem that it should not be such a great trial for people to remain strong and firm in their emunah. But the truth is that even though the prophets made this known long ago, it will still be a great trial. Many will fall by the way, and that is why it is written: "the wicked will do evil."

I am revealing this for the sake of the few pure souls who will remain firm in their emuna. They will certainly face great battles even in their own minds. But when they see that this has already been predicted, it will give them greater strength and encouragement — Sichot Haran #35

Abortion is NOT compassionate for mothers and it certainly is not compassionate for the murdered children. Hence, as Shabtai bar Marinus teaches us in the Talmud cited above, supporting child murder arises from the spirit of the erev rav and Amalek, regardless of the sad fact that some American and Israeli Jews have embraced sacrificing their children to Molech. When the majority view is barbaric and violates Holy Scripture the majority are wrong! Otherwise the Torah is meaningless, G-d forbid!

Our Creator’s View On Abortion

Exodus 1:5 You shall not murder.

Jeremiah 1:4-5 Now the word of the LORD came to me, saying, “Before I formed you in the womb I knew you, and before you were born I consecrated you; I appointed you a prophet to the nations.”

Psalms 139:13-16 For You created my reins, You covered me in my mother's womb. I shall thank You for in an awesome, wondrous way I was fashioned; Your works are wondrous, and my soul knows it very well. My essence was not hidden from You, when I was made in secret, I was formed in the lowest parts of the earth. Your eyes saw my unformed body, and on Your book they were all written; days have been formed and one of them is His.

Isaiah 49:1,5 Listen to me, O coastlands, and give attention, you peoples from afar. The LORD called me from the womb, from the body of my mother he named my name… And now the LORD says, he who formed me from the womb to be his servant, to bring Jacob back to him; and that Israel might be gathered to him—for I am honored in the eyes of the LORD, and my God has become my strength.

Isaiah 44:2 Thus says the Lord who made you, who formed you from the womb and will help you: Fear not, O Jacob my servant, Jeshurun whom I have chosen.

Psalms 22:9-10 Yet you are he who took me from the womb; you made me trust you at my mother’s breasts. On you was I cast from my birth, and from my mother’s womb you have been my God.

Psalms 51:5 Behold, I was brought forth in iniquity, and in sin did my mother conceive me.

Genesis 25:22-26 The children struggled together within her, and she said, “If it is thus, why is this happening to me?” So she went to inquire of the LORD. And the LORD said to her, “Two nations are in your womb, and two peoples from within you shall be divided; the one shall be stronger than the other, the older shall serve the younger.” When her days to give birth were completed, behold, there were twins in her womb. The first came out red, all his body like a hairy cloak, so they called his name Esau. Afterward his brother came out with his hand holding Esau’s heel, so his name was called Jacob. Isaac was sixty years old when she bore them.

Judges 13:2-5 There was a certain man of Zorah, of the tribe of Dan, whose name was Manoah. And his wife was barren and had no children. And the angel of the LORD appeared to the woman and said to her, “Behold, you are barren and have not borne children, but you shall conceive and bear a son. Therefore be careful and drink no wine or strong drink, and eat nothing unclean, for behold, you shall conceive and bear a son. No razor shall come upon his head, for the child shall be a Nazirite to God from the womb, and he shall begin to save Israel from the hand of the Philistines.”

Job 31:15 Did not he who made me in the womb make him? And did not one fashion us in the womb?

Genesis 1:26-27 Then God said, “Let us make man in our image, after our likeness. And let them have dominion over the fish of the sea and over the birds of the heavens and over the livestock and over all the earth and over every creeping thing that creeps on the earth.” So God created man in his own image, in the image of God he created him; male and female he created them.

Proverbs 24:11-12 Rescue those who are being taken away to death; hold back those who are stumbling to the slaughter. If you say, “Behold, we did not know this,” does not he who weighs the heart perceive it? Does not he who keeps watch over your soul know it, and will he not repay man according to his work?

Genesis 9:5-6 And for your lifeblood I will require a reckoning: from every beast I will require it and from man. From his fellow man I will require a reckoning for the life of man. “Whoever sheds the blood of man, by man shall his blood be shed, for God made man in his own image.”

Psalms 8:4-5 what is man that you are mindful of him, and the son of man that you care for him? Yet you have made him a little lower than the heavenly beings and crowned him with glory and honor.

Exodus 21:12 Whoever strikes a man so that he dies shall be put to death.

Exodus 21:22-25 And should men quarrel and hit a pregnant woman, and she miscarries but there is no fatality, he shall surely be punished, when the woman's husband makes demands of him, and he shall give [restitution] according to the judges' [orders].But if there is a fatality, you shall give a life for a life, an eye for an eye, a tooth for a tooth, a hand for a hand, a foot for a foot, a burn for a burn, a wound for a wound, a bruise for a bruise.

Deuteronomy 27:25 ‘Cursed be anyone who takes a bribe to shed innocent blood.’ And all the people shall say, ‘Amen.’

Exodus 23:7 Keep far from a false charge, and do not kill the innocent and righteous, for I will not acquit the wicked.

Isaiah 49:5 And now the Lord says, he who formed me from the womb to be his servant, to bring Jacob back to him; and that Israel might be gathered to him— for I am honored in the eyes of the Lord, and my God has become my strength—

Isaiah 13:18 Their bows will slaughter the young men; they will have no mercy on the fruit of the womb; their eyes will not pity children.

Deuteronomy 27:25 “‘Cursed be anyone who takes a bribe to shed innocent blood.’ And all the people shall say, ‘Amen.’

Hosea 12:3 In the womb he took his brother by the heel, and in his manhood he strove with God.

Ecclesiastes 11:5 As you do not know the way the spirit comes to the bones in the womb of a woman with child, so you do not know the work of God who makes everything.

2 Kings 8:12 And Hazael said, “Why does my lord weep?” He answered, “Because I know the evil that you will do to the people of Israel. You will set on fire their fortresses, and you will kill their young men with the sword and dash in pieces their little ones and rip open their pregnant women.”

Psalm 127:3-5 Behold, children are a heritage from the Lord, the fruit of the womb a reward. Like arrows in the hand of a warrior are the children of one's youth. Blessed is the man who fills his quiver with them! He shall not be put to shame when he speaks with his enemies in the gate.

Proverbs 6:16-19 There are six things that the Lord hates, seven that are an abomination to him: haughty eyes, a lying tongue, and hands that shed innocent blood, a heart that devises wicked plans, feet that make haste to run to evil, a false witness who breathes out lies, and one who sows discord among brothers.

2 Kings 15:16 At that time Menahem sacked Tiphsah and all who were in it and its territory from Tirzah on, because they did not open it to him. Therefore he sacked it, and he ripped open all the women in it who were pregnant.

Leviticus 18:21 You shall not give any of your offspring to offer them to Molech, nor shall you profane the name of your God; I am the LORD.

In short:

Deuteronomy 30:19 Choose life so that you and your children will live. And love God, your God, listening obediently to him, firmly embracing him. Oh yes, He is life itself, a long life settled on the soil that God, your God, promised to give your ancestors, Abraham, Isaac, and Jacob.

Such verses are found throughout the Tanach! When HaShem speaks of life He does so to demand it be honored and protected, not destroyed!

Murdering children IS NOT A JEWISH VALUE.
Murdering children VIOLATES THE LAW OF G-D.
Murdering children VIOLATED THE HUMAN DECENCY.
Murdering children WAS PRAISED BY MOLECH BUT CONDEMNED BY HASHEM
Civilized people do not MURDER THEIR CHILDREN.
